The President of the Senate (who is also the Vice President of the United States), in presiding over the count of electoral votes for President and Vice President, and not the States, has the “ultimate Constitutional jurisdiction over the process.”
The President of the Senate is to open the electoral votes, sent by the Electors, and to preside over their counting. If in his or her judgment the votes do not have a certain majority, he or she is to call for the House of Representatives, by State delegations, to elect the President and Vice President of the United States.
